Executive Branch Passes Phase 3 of the ‘Resumption of Economic Activities’: Modifies Registry of Operations and Anti Money Laundering Regulations

On July  1, the Executive Branch issued Supreme Decree No. 117-2020-PCM for Phase 3 of the Resumption of Economic Activities in the context of the national health emergency. Meanwhile, the Single and Multiple Operations Registry, known as the RO instructions, and the Money Laundering and Financing of Terrorism Risk Management Regulations were also amended.

Decree 117 stipulates that all businesses must draw up their “plan for the surveillance, prevention and control of COVID-19 in the workplace”, to be made available to workers and users, as well as to the competent authorities for inspection.

In addition, the Superintendency of Banking and Insurance (SBS, for its acronym in Spanish), adopted SBS Resolution No. 1743-2020, modifying the date of entry into force of the RO instructions to January 1, 2021. In turn, the Regulation on the Management of the Risks of Money Laundering and Financing of Terrorism requires companies to set up a register of national and/or international transfers with intermediation (sending and receiving funds).

In addition, the Superintendency of the Securities Market (SMV, for its acronym in Spanish), issued Resolution No. 056-2020-SMV/02, which published provisions for the exercise of the right to speak in non-attendance hearings held on an electronic platform by those covered, which includes processing administrative sanction procedures.
