Indecopi launches guide on compliance program with free competition rules

On June 3, the Commission for the Defense of Free Competition of Indecopi (CLC, for its acronym in Spanish) launched the “Guide to the Program for Compliance with Free Competition Standards” to help companies understand the elements to be adopted to prevent and minimize the risk of infringing free competition laws. 

The commission established that these programs may apply to various matters, such as norms on money laundering, taxation, environment, labor, and free competition. Indecopi’s goal is for the guide to serve as a tool for companies as they plan to adopt both essential and complementary aspects of their own programs.

Similarly, the document provides incentives for companies to voluntarily adopt policies to comply with free competition regulations and for these to be disseminated among their employees. 

In addition, companies are empowered to define the scope of the elements making up their Compliance Programs, as well as the methodologies for their design, implementation and evaluation, in accordance with their own needs and characteristics.
