Executive branch presents draft bill on personal data protection

On February 14 the National Directorate of Public Data Registration (DINARDAP) presented the draft bill on personal data protection. It proposes the incorporation of new rights for data owners. It also postulates that credit data will be considered sensitive data, obliging entities to request express consent to use them. The draft is not yet final, so the final bill could include further changes. DINARDAP has not yet set a date for the presentation of this final version.

 

Among the new rights those of access, rectification, correction (or elimination) and opposition to the information collected stand out. It also proposes that the companies that process these data must previously inform the owners regarding the use that will be given to them and the time that they will keep this information. For sensitive data, including credit data, it will be necessary to have the explicit consent of the users to use this information. DINARDAP will be the control body that will ensure compliance with these provisions.

 

DINARDAP is working on the final details of the draft bill. It should be noted that the Directorate has not yet set a deadline to present the final bill. When this finally happens, it will be sent to the Ministry of Telecommunications for further study. If the Ministry endorses its content, it will be forwarded to the Presidency of the Nation so that it can elevate it to the National Assembly.
