CHILE

On February 23, the Knowledge Systems Committee of the Constitutional Convention discussed and voted on new initiatives, among which stands out one that seeks to establish that native peoples and nations have the right to practice their customs and traditions and are recognized the power to protect them against people who may misuse their material elements or distort their cosmogonic sense. It is expected that this initiative will be included in the next systematized texts of the committee, to be voted on in the plenary of the Convention.

In addition, the text proposes that the native community may bring the matter before the State courts to take action against an outsider who misuses its cultural elements, and may even be punished if the distortions are criminal in nature.
