The Secretary of Finance and Public Credit (SHCP, in Spanish) launched a public consultation, via the National Regulatory Improvement Commission (CONAMER, in Spanish), wic modifies the general provisions regulating investments made by specialized retirement funds. The regulations will remain open for comments for at least the next 20 days; those interested can send their opinions by accessing the following link.
The draft text proposes that:
- The National Retirement Savings System Commission will disclose the following information on its website: the list of Vehicles; Stock Indices of Countries Eligible for Investments; the Real Estate Indices of Countries Eligible for Investments; the Debt Indices of Countries Eligible for Investments authorized in accordance with the criteria issued by the Risk Analysis Committee.
- To invest in these so-called indices, investment companies must act as follows:
a) Vehicles. Provide the Commission with sponsor information on the corresponding vehicle in accordance with the provisions of the general rules regarding the delivery of information by retirement fund managers, specialized retirement fund investment companies, receiving entities and operating companies on the National SAR Database, to the National Retirement Savings System Commission.
b) Stock Indices of Countries Eligible for Investments, Real Estate Indices of Countries Eligible for Investments and the Debt Indices of Countries Eligible for Investments. Companies must notify the Commission in writing regarding their respective sponsors.
