Deputies Begin Work on Constitutional Protection of Personal Data

On August 13, the Constitution and Justice Committee of the Chamber of Deputies passed the admissibility of the proposed amendment to include the protection of personal data in the Constitution. The bill, which had been previously passed in the Senate, must now be studied in a special Deputies’ committee.

The initiative filed by Senator Eduardo Gomes (Movimiento Democrático Brasileiro – allied with the ruling party), proposes providing constitutional guarantees to protect the personal data of both Brazilians and foreigners residing in the country, including data available on digital media. The proposal also enshrines the power to legislate on personal data protection and processing.

The Senate passed the bill earlier on July 2, but as this measure seeks to amend the Constitution, its legislative process is more complex, and it must be passed by a special committee before going to the Representatives’ Plenary.
