Senate approves bill that regulates electronic promissory notes and Congress begins legislative recess until September 2021

On April 29, the Senate approved the bill to include digital documents governed by electronic commerce, as well as electronic signatures, as acts and operations regulated by negotiable instruments. The text was sent to the Chamber of Deputies, where it would be taken up again after the legislative recess. In this regard, on April 30, the current ordinary session of the Congress ended, thus initiating the recess. In view of this, the Senate constituted the Permanent Committee, which will operate until September 1, 2021 and which will have the power to call extraordinary sessions for the plenary to consider specific bills.

 The approved initiative of electronic promissory notes establishes several mechanisms to regulate electronic activities through physical or digital documents issued by individuals or legal entities, so it contemplates that any credit instrument may now be used through existing technological means, as long as its legitimacy is guaranteed. In addition, it provides that lawsuits involving electronic instruments of credit must be processed through the executive lawsuit.

 On the other hand, in order to operate during the legislative recess, the Permanent Committee was formed with 19 deputies and 18 senators, respecting the proportional criterion of political representation existing in both chambers. This body will have the power to receive bills and send them to committee; to approve exhortations to the Executive Branch; and to call extraordinary sessions of both chambers of Congress. In no case may it approve or sanction bills, although the initiatives may be approved in the permanent advisory committees of each chamber, but they may only reach the plenary sessions after calling an extraordinary session.
