Superintendence of the Securities Market puts in public consultation projects of securitization of assets and entrance of proposals to the negotiations of the Securities Exchanges
15 febrero 2019

On February 13, the Superintendence of the Securities Market (SSM), through Resolutions 005-2019-SMV/01 and 006-2019-SMV/01, put in public consultation a project on asset securitization and another that reforms the regulations of the Latin American Integrated Market (LAIM). In both cases, everyone who is interested will be able to make opinions on the content of the projects until February 23.

The first one, on asset securitization, contains provisions about the minimum information that must be contained in a trust’s constitutive act and, also, that which must be presented for the registration of assets issued with the backing of trust assets in the Public Registry of the Securities Market. In addition, it includes procedures for the submission of information related to securitization trusts and the documents necessary for enrollment in the Registry of securities issuance programs under securitization processes.

The Latin American Integrated Market was created to facilitate the supply and public intermediation of primary and secondary securities. In this sense, the project presented seeks to promote the growth and diversification of investment alternatives through the Lima Securities Exchange. To this end, it proposes that the entry of proposals to the trading systems of the Securities Exchanges may be carried out not only through foreign intermediaries by the intermediary routing mechanism, but also through a local intermediary.
