A public consultation opened to regulate corporate responsibility for bribery

The Ministry of Justice and Human Rights issued Resolution Nº. 0061-2018, to consult on a preliminary draft of the “Regulation of Law Nº 30424, which regulates the administrative responsibility of legal persons for the crime of transnational active bribery”. Law Nº 30424 establishes measures on the administrative responsibility of legal persons for special crimes of active bribery, money laundering and financing of terrorism.

The draft lists the obligations of companies, which include identifying operational processes and risks and developing systems for the systemic examination and impact of those risks. Likewise, the companies will have to assume and implement controls and preventive measures, detection and risks corrections.  

The deadline for the issuance of the regulation expired on June 20th, 2016. The draft is available for consultation until March 15th, 2018 in the website of the Ministry of Justice and Human Rights (www.minjus.gob.pe). After that, the Ministry will study the recommendations made, in order to decide whether they will be included in the final draft or not.
