Ministry of Economy publishes rules for the implementation of the regulatory sandbox

On May 18, the Ministry of Economy, through Instruction No. 626, established the rules for the constitution and operation of the regulatory sandbox in Brazil. The regulation will be in force as of June 1, 2020. You can access it by clicking here.

This Instruction regulates the implementation of the experimental regulatory environment, in which participating legal entities may receive temporary authorizations to test “innovative business models” in market activities regulated by the Securities and Exchange Commission.

According to the text, among the objectives of the regulatory sandbox are the development of innovation in the capital market and the promotion of financial inclusion through the launch of “less costly and more accessible” financial products and services.

The regulation also defines, among other points, the access rules to the regulatory sandbox, the eligibility criteria and the supervision of the activities to be carried out in this area.
