On February 9, the National Consumer Service (SERNAC in Spanish) published the opening of a public consultation so that citizens, companies and other stakeholders can comment on the Interpretative Circular on abusive clauses regarding the processing of consumers’ personal data. It should be noted that the purpose of the circular is to interpret the rules relating to abusive clauses in adhesion contracts referring to the collection and processing of consumers’ personal data, stipulations normally included in the terms and conditions and/or privacy policies.
It also examines various types of clauses or contractual conditions written by suppliers that lead to an imbalance between the contracting parties, contravening the principle of contractual good faith to the detriment of the rights and interests of consumers who are holders of personal data.
