Permanent Committee receives appointments for IPAB and CONSAR opens public consultations regulating AFORES

On January 19, a series of events of interest to your industry took place. Here are more details:
- The Permanent Committee of Congress received the proposed appointment by Andrés Manuel López Obrador (AMLO) of Diana Álvarez Maury and Carlos Romero Aranda as members of the Board of Governors of the Institute for the Protection of Bank Savings (IPAB in Spanish), and turned it over to the full Senate. Diana Álvarez Maury holds a law degree from Instituto Tecnológico Autónomo de México and a master’s degree in Business Administration. In the professional field, she has served as Undersecretary of Prevention, Citizen Participation and Religious Affairs of the Secretariat of the Interior between 2018 and 2020, and was General Director of Banco del Bienestar between 2020 and 2021. Carlos Romero Aranda holds a law degree from Centro Universitario México. He also has a doctorate degree in Tax Law and a master’s degree in Tax Law, as well as a doctorate degree in Financial and Tax Law. In the professional field, he was the Federal Tax Prosecutor between 2018 and 2021. The proposal was sent to the Senate which would begin its consideration once the ordinary session begins on February 1, 2022
- The National Commission of the Retirement Savings System (CONSAR in Spanish), opened, through the National Commission for Regulatory Improvement (CONAMER in Spanish), a public consultation that makes modifications to the General Provisions on financial matters of the Retirement Savings Systems. The draft bill establishes that the Retirement Funds Administrators (AFORES in Spanish), must prove compliance with the considerations on special reserve amounts that these entities must have, established in the sixth provision of the Provisions applicable to the AFORES that regulate their special insurance funds. The consultation will remain open for at least 20 days, and interested parties may send their comments at the following link.
- CONSAR opened another public consultation by which it empowers the Legal Vice President of the institution to impose sanctions on the Retirement Fund Administrators (AFORES) that fail to comply with or violate regulatory provisions that regulate them. The text also specifies that the Vice President must inform the President of CONSAR of the status of the matters and the exercise of the powers delegated to him/her. The consultation will remain open for at least 20 days, and interested parties may send their comments through the following link.
