SHCP opens public consultation on information to be provided by investment funds

On November 10, the Secretariat of Finance and Public Credit (SHCP in Spanish), through the National Commission for Regulatory Improvement (CONAMER in Spanish), opened a public consultation regarding the delivery of information on services contracted by investment funds. The text establishes the information related to financial statements that must be provided to the National Banking and Securities Commission (CNBV in Spanish). The consultation will remain open until at least December 8, and interested parties may send their opinions through the following link.

The draft, which amends the General Provisions applicable to investment funds and the persons that provide services to them, establishes that when private parties notify the CNBV of the name of the pricing provider they hire, they must attach a copy of the service contract. 

At the same time, investment funds are obliged to request the corresponding information from their pricing provider in order to comply with the disclosure requirements for the determination of the updated price for valuation purposes.
