Executive Branch Modifies Regulation of TV Law: Digital Services Bill Sent to Economic Committee

On September 16, the Executive Branch modified the Regulations of the Radio and Television Law establishing a simplified and temporary regime for handling requests for authorization to provide audio or TV broadcasting services. In other news, the Secretariat of Congress sent the bill facilitating VAT collection for digital services to the Economy, Banking and Finance Committee, which means that it will be sent to the committee in the next few days.

Modification of Radio and TV Regulations 

The Executive Branch issued Supreme Decree No. 019-2020-MTC, which establishes that the new authorizations for the TV broadcasting services will be granted through public tender, if there are no spectrum restrictions. In turn, in January of each year, the General Directorate of Telecommunications Authorizations will draw up the timetable for at least two public calls for tender that year, depending on the number of locations.

The regulation also envisages a simplified temporary regime to treat requests for authorization to provide radio and TV broadcasting, presented until December 31, 2020.

Bill to facilitate the collection of the IGV of digital services.

The initiative presented by Betto Barrionuevo (Somos Perú) proposes that credit cards be used as collection agents for payments made for the import of digital services rendered or contracted through the Internet or any other platform. The Economy Committee is expected to start its study in the next few days.

The regulation seeks to establish the mechanisms for collecting VAT on the import of digital services provided or contracted through the Internet or any other platform and proposes designating financial entities to act as collection agents for these payments.
