Deputies’ Security Committee Begins General Discussion of Bill Adapting Standards on Computer Crimes to Budapest Convention

On September 23, the Deputies Security Committee began its general discussion of the bill establishing rules on computer crimes and modifying other legal bodies in order to adapt them to the Budapest Convention. Among the crimes involved are fraud and computer forgery. The committee will continue analyzing the initiative in future sessions.

The proposal seeks to criminalize a series of conducts in order to bring the Chilean regulatory framework in line with the Budapest Convention. These include an attack to the integrity of a computer system, illegal access, illegal interception, attack on the integrity of computer data, computer forgery, computer fraud and device abuse.

It also incorporates a new figure concerning data reception, which sanctions anyone who, whether knowing its origin or not, and who may be less than aware of it, stores, for whatever reason, computer data acquired from illegal access, illegal interception and computer forgery.
