Bill Presented to Regulate Teleworking

On August 6,  legislator José Antonio Núñez (Partido Morado) presented an initiative to regulate teleworking, enshrined in the Peruvian legal system as a working modality applicable to the private sector. The proposal applies to both normal and exceptional circumstances, and is expected to be turned over to committee in the coming days.

The bill proposes that workers under the modality enjoy the same rights and obligations established in each activity, regardless of whether they are working in the workplace or not. The employer must apply the particular and characteristic remunerations and social benefits of each job, taking into account the concurrent factors of teleworking in order to avoid workers being harmed or discriminated against. 

The proposal also considers that the person who is under this modality will be authorized to modify the established hours for the provision of services, respecting the regulations on the matter, except when they have to comply with mandatory times of availability. 

Finally, the bill stipulates that the teleworker has the right to intimacy, privacy and the inviolability of communications and private documents.
