On October 29, the Constitutional Court’s (CC) plenary session unanimously agreed to study the appeal presented by Permanent Committee president Pedro Olaechea against the dissolution of Congress enacted by President Martín Vizcarra. The Court must analyze the claim to decide whether President Vizcarra violated the Constitution. 

During the session, the Constitutional Court described as “inappropriate” the injunction presented by Olaechea to suspend the effects of the dissolution of the Legislature on September 30, with a view to allowing Congress to continue in function, and not just the Permanent Committee. This claim was rejected by five votes to two.  

The Presidency of the Council of Ministers responded that the Executive Branch “respects” the decisions of the constitutional court and pointed out that the legislative elections scheduled for January 26, 2020 “are not in debate”. “Elections must take place in a completely normal manner and citizens have nothing to worry about,” said the Council.
