Executive Announces Business Merger Control Decree and Government Plan

On October 30, the president of Peru Martin Vizcarra announced that the Council of Ministers had given the green light to an emergency decree aimed at controlling corporate mergers. Vizcarra said that this measure will “guarantee a framework of adequate business competition,” as it aims to “evaluate mergers and prohibit those affecting users.” The decree is expected to be published in the Official Gazette in the coming days.

Vizcarra’s announcement was made during the presentation of the Ministerial Cabinet’s “work plan and measures” given by Prime Minister Vicente Zeballos and also referred to a series of upcoming measures. These will be based on the five axes of his administration: integrity and the fight against corruption, institutional strengthening, equitable economic growth, social development and decentralization for development.

Zeballos added that they will boost measures to promote economic growth and implement the national competitiveness and productivity policy, although he did not provide any further details at this stage. He also mentioned that they are working to develop a Multisectoral Strategic Plan for Financial Inclusion to build confidence among the population. 

On October 28, the National Customs and Tax Administration Superintendency approved the Manual and Procedures for the Management of Audits, and Actions to Improve the Anti-Bribery Management System. The idea is to implement measures to prevent, detect and deal with bribery of any form, as well as tackle different types of corruption. In addition, the Superintendency also published the Actions to Improve the Anti-Bribery Management System.
