SMV Opens Public Consultations on Guidelines for Prevention Model and Application of Stock Market Law

On September 30, the Securities Market Superintendency (SMV for its acronym in Spanish) published two calls for public consultations. The purpose is to encourage the implementation of prevention models for crimes involving bribery. The SMV is considering a draft regulation establishing guidelines to implement the Prevention Model as part of this procedure which will be open until Friday, November 29, 2019. The SMV also opened a second consultation on preventing abusive practices in the Stock Market which will be open until Tuesday, October 29, 2019. 

 

Through Resolution Nº 021-2019-SMV/01, the SMV proposed a draft regulation to serve as a legal reference tool to assist in the design, implementation and operation of the bribery prevention model. It should be noted that the guidelines established are to be considered reference elements for the development of the prevention model referred to in law 30424

In resolution No. 022-2019-SMV/01, the SMV proposes approving the provisions for the application of subparagraph d) of article 12, and article 156 of the Stock Market Law, published through Legislative Decree No. 861. The aim is to prevent market abuse, preventing those people who by virtue of their public function may have access to information not disclosed to the market, from using it for their own benefit or for the benefit of third parties. Interested parties may make their observations until October 29, 2019.
