Peruvian Government Approves Entry Into Force of Convention on Cybercrime

On September 23, the Executive branch of Peru set a date for the entry into force of the Convention on Cybercrime of the Council of Europe, also known as the Budapest International Convention on Cybercrime, which it had pledged to join in February 2019 through Resolution No. 30912. The Convention will come into effect in Peru as of December 1, 2019.

The Treaty aims to boost cooperation between signatory states and the private sector in the fight against cybercrime, and to protect legitimate interests in the use and development of information technologies.

The crimes covered include attacks on data integrity, counterfeit and computer fraud as well as crimes against intellectual property.  

In February, Peru signalled its wish to adhere to the treaty, while submitting reservations concerning some of the clauses and articles contained in the original document. Countries wishing to join the Convention may apply to do so while submitting the reservations they deem necessary. The Council of Europe will then evaluate the ratification and choose whether to approve or reject it.
