National Assembly seeks alternatives to legislate amid prosecutions of deputies

On August 12, the National Constituent Assembly (ANC) gave the go-ahead to prosecute various deputies of the National Assembly (AN) – José Guerra, Rafael Guzmán, Juan Pablo García and Tomás Guanipa – who are accused of committing crimes against the State. In all, there are 19 legislators facing prosecution in connection with events taking place between April 30 and May 1, in addition to the 4 who were stripped of their parliamentary immunity between 2017-2018. 

Juan Guaidó decried the decisions of the Superior Court of Justice and the ANC as unconstitutional, and declared that the National Assembly “springs from popular sovereignty so cannot be eliminated or dissolved”. 

Congresswoman Dennis Fernandez confirmed during the establishment of a Delegate Commission on August 15 that options are being looked at to enable deputies that are being prosecuted, persecuted or exiled to participate and vote. In this sense, she stated that they are not thinking of “replacing the face-to-face parliament with a virtual parliament (…)” and that they are considering the implementation of a modality of participation by videoconference.
