Executive Branch opens public consultation to update regulations on the acquisition of medicines

On June 14, the Executive Branch, through the National Commission for Regulatory Improvement (CONAMER in Spanish), opened a public consultation to update the federal regulations governing public tenders for the procurement of medicines and health supplies. The regulation specifically seeks to regulate the simultaneous bidding of items, that is, bidding processes where different amounts of a total percentage of an item are assigned to multiple bidders. This includes all types of medicines that the public sector purchases for its public health system. The text will be under consultation until at least July 9, and interested parties can send their opinions through the following link.

The text under consultation proposes to modify Article 59 of the Regulations of the Public Sector Procurement, Leasing and Services Law. In the first place, it establishes that during a public bidding process it must be proven that the free participation of bidders of the inputs put out to bid has not been limited.

It also establishes that in the case of the acquisition of medicines and health supplies to guarantee their supply, the pricing and allocation of items will not be subject to the same requirements as under normal conditions.

Finally, the text mentions that if a quantity of goods is pending allocation, the remainder may be awarded to the supplier selected first, and if the latter does not accept, to the supplier in second place.
