Article 200 of the Venezuelan Constitution sets out four central pillars on parliamentary immunity:

1. National Assembly deputies enjoy immunity in the exercise of their functions from the time of their proclamation until the end of their mandate or their resignation.
2. In the case of alleged crimes, the Supreme Court of Justice is the only authority with competence to order the detention of deputies. They must have the prior authorization of the National Assembly in order to continue their prosecution.
3. In the event of a flagrant offence, the competent authority may place the legislator in custody at his/her residence, after which he must immediately inform the Supreme Court of Justice.
4. Public officials who violate the immunity of members of the National Assembly are criminally liable.
