Joint Committee passes provisional measure creating the National Data Protection Authority

On May 7, the Congress Joint Committee passed the Provisional Measure creating the National Data Protection Authority., while on May 8, the Constitution and Justice Committee filed a petition for a public hearing to discuss the composition and faculties of the new entity. The provisional measure will have to be passed by both chambers before being enacted.

The Joint Committee analyzing the Provisional Measure decided that the National Data Protection Authority (ANPD) will be a public administration body responsible for implementing and supervising compliance with the Personal Data Law in Brazil, as well as penalizing any non-compliance.

The Authority will be made up of representatives from a Board of Directors; the National Council for the Protection of Personal Data; the Attorney-General’s Office and the Ombudsman’s Office, among other specialized entities. The appointment of the members of the National Authority Directors Board must get the green light from the Senate, as in the case of all members of other regulatory bodies.

The petition for the hearing was filed by Deputy Luiz Flávio Gomes (Brazilian Socialist Party – opposition) to debate the composition and faculties of the ANPD, emphasizing that it is “of utmost importance” to ensure legal security for people’s “privacy and dignity.” The date of the hearing has not yet been confirmed.

The Provisional Measure passed in Committee will be debated on the floor of the Chamber of Deputies and Senate.
