DINARDAP to send a bill on personal data protection to the Ministry of Telecommunications in May

The National Director of DINARDAP (National Directorate for the Registry of Public Data), Lorena Naranjo Godoy, announced today that the drafting of a bill on the protection of personal data will be completed soon. Godoy explained that the presentation schedule was delayed due to adjustments made in recent months to ensure that the law “favors companies, citizens and all those who handle personal data”. DINARDAP plans to send the bill to the Ministry of Telecommunications (Mintel) in May for evaluation and review. It will then be passed to the President as the last step before being presented to the National Assembly.

The bill would introduce provisions to ensure the proper use and protection of citizens personal data. It will cover all personal data in any kind of format, both in the public and private sectors. DINARDAP will be the control agent, will ensure compliance with the law’s provisions and may apply penalties if necessary. In relation to the international transfer of personal data, this would only be possible if carried out with countries that have adequate levels of protection. This will be assessed according to existing regulations in each requesting country.
