Securities Commission opens consultation to regulate Investment Funds Law while AFIP extends deadline for complying with a financial information regime

On March 15 the National Securities Commission (CNV) launched through Resolution 787/2019 a public consultation in order to regulate Articles 4, 7 and 17 of Law 24.083 on Investment Funds. Interested parties may submit their opinions and proposals until April 8 on the CNV website.

 

The purpose is to establish new exceptions to the legal prohibition relating to investment in transferable securities issued by the Management Company or the Custodian, or in shares of other mutual funds. It also seeks to adapt regulations regarding the use of accounts opened with the custodian of the fund for the payment of fees, commissions and expenses. In addition, banks will have until 1 April 2019 to comply with the information regime on operations carried out by their customers during 2018 to pay interest or income. The decision was made on March 15 through Resolution 4438/2019 of the Federal Agency of Public Revenues. The regime had been established by AFIP on January 2 by means of Resolution 4394/2019 .
