Executive branch enacted Peru’s accession to the Budapest Convention on Cybercrime

On February 13, the Executive enacted, through Legislative Resolution 30913, Peru’s accession to the 2001 Budapest Convention on Cybercrime, unanimously passed by Congress at the end of January.  This Convention is the first international treaty to address the definition of crimes executed through computer networks, and allows countries that signed it to share information on cybercrime.

 

The ratification of the treaty was made with reservations. As a result, the Peruvian State decided not to adhere to the entire convention. For example, Peru did not adhere to the possibility of defining in its domestic law a certain number of devices and computer data in the possession of criminals as a necessary condition for adjudicating criminal responsibility.

 

In addition, with respect to paragraph 4 of Article 29 on the conservation of stored data, Peru reserves the right to refuse a request for mutual assistance in this matter when it has reason to believe that the requirement of double criminality is not being complied with.
