Public Safety Committee opens debate on cybercrime bill

The Senate´s Public Security Committee has begun debating a bill that would modify the legislation on ICT-related crime, and which would bring Chile into line with the Budapest Convention (Exp. 12192).  Among the seven new computer crimes outlined, of particular interest are those relating to computer fraud and the misuse of devices.  The committee will begin a series of meetings with interested stakeholders next week, with the bill set to be passed in the first week of December.

The bill incorporates the definitions of the Budapest Convention into Chilean regulation. It sets out seven new crimes, including on computer fraud and the abuse of devices. It carries stiff penalties for offenders, with jail sentences of up to 61 years. The bill also paves the way to new special investigative techniques, such as undercover agents, the use of informants, and the interception of communications.

The bill is part of the National Cybersecurity Policy (2017-2020) that the Executive Branch is spearheading to improve the resilience of Chile’s computer infrastructure. It will update the current legislation, created in 1993, which was mainly focused on physical ICT infrastructure. The bill will complement the existing legislation,  including in the stipulation of crimes committed from or through computer platforms or software.
