Both chambers discuss bills for the protection of personal data

On Wednesday, April 18th, the Chamber of Deputies’ Constitution Committee met to analyze modifications to bill No. 9384-07, which modifies Article 19 of the Constitution to grant constitutional hierarchy to the protection of personal data. At the meeting, which was attended by specialists in the field, the deputies agreed to reject the changes proposed during the floor last Tuesday, April 10th, and approved the bill with its original wording. In this way, the initiative must be studied again by the floor ot Chamber of Deputies. The debate and voting of this initiative could happen during the month of May.

 

At the same time, the Senate’s Transport and Telecommunications Committee met Thursday, April 19th, to study bill No. 11037. This bill, like the one being discussed by the Chamber of Deputies, also modifies Article 19 of the Constitution, but proposes more comprehensive reforms. It establishes the right to internet access, the protection of privacy in digital environments, and establishes that the State will promote free and equal access to the public network. The senators agreed to continue the study of the text May 2nd. There is still no definitive draft for the bill, which must be analyzed by the Senate Constitution Committee before being debated in the floor.

 

Senators affirmed that their bill and that of the Chamber of Deputies are compatible. They foresee that, in the event that bill No. 9384 concludes its parliamentary procedure and the constitutional reform is enforced, they will make the necessary adjustments to ensure the compatibility of the reforms.
